Picture Frame Warehouse Contest Rules
1. Agreement: These rules govern Picture Frame Warehouse Contest (“Contest”). No purchase is necessary to enter the Contest. The act of entering the Contest constitutes acceptance of the Contest rules and the decisions of the Contest judges, which decisions shall be final and binding upon all entrants.
2. Sponsor: The Contest sponsor is Picture Frame Warehouse (“Sponsor”).
3. Eligibility: This Contest is open only to legal residents of Ontario 18 years of age or older., except for employees, their immediate families and anyone living with any employee of the Sponsor or its or their corporate affiliates, advertising or promotional agencies. Limit of one entry per person. Incomplete or illegible entries will not be accepted and will be disqualified.
4. Contest: To enter the Contest, access the Contest website at pictureframewarehouse.com/rules.html, read these Contest rules, and follow the instructions to enter during the Contest period (a valid email address will be required). The Contest begins at February 8th, 2012 at 9:00am and ends at May 8th, 2012 at 9:00am. A qualified panel of sponsor’s judges will judge Eligible entries. All decisions of the Contest judges are final.
The potential winners will be contacted by telephone or email by a representative of the Sponsor, and must reply within 72 hours to maintain eligibility. If the potential winner cannot be contacted within this time period or fails to respond to any attempted contact, such potential winner will be disqualified, his/her entry will be declared null and void and the Sponsor reserves the right, in its sole and absolute discretion, to select another eligible entry, in which event these provisions shall apply to such other eligible entry.
5. Prize:
One (1) Prize: 1 framing gift certificate redeemable at Picture Frame Warehouse.
The approximate retail value of the prize is $50 CAD plus applicable taxes.
Winners must come to 387 Ontario St, St. Catharines, ON to collect the prize won. If the winner does not claim the prize within thirty (30) days of notification, the next eligible entry selected will be contacted and the first selected entrant will have no further claim to the prize. Sponsor will not mail or courier the prize and is not responsible for unclaimed prizes.
6. Release: Prior to receiving the prize, the winner will be required to show valid photo ID and to sign a declaration of eligibility and release form releasing the Sponsor and its related parties from any and all liability in connection with the Contest and/or the prize, confirming compliance with the rules and consenting to the use of his or her name and photograph, without further compensation, in any publicity carried out by the Sponsor and/or its advertising and promotional agencies. The signed form must be received by Sponsor within prior to confirmation as prize winner or the prize may be released and awarded to an alternate entrant. By entering the Contest, entrants agree to hold harmless and indemnify Picture Frame Warehouse, and each of their respective subsidiaries, affiliates, directors, officers, governors, agents, their advertising and promotional agencies against any and all liability, damages or causes of action (however named or described with respect to or arising out of either: (i) entrant’s participation in the Contest; (ii) the receipt or use of the Prizes awarded herein; or (iii) the administration of the Contest (including winner selection) and distribution of the Prizes awarded herein.
7. Privacy: We use your personal contact information to administer this Contest, including contacting, announcing and promoting prizewinners. In addition, we may use this information to send you offers or information from us, our affiliates and from selected sponsors or advertisers (“Marketing Offers”). If you do not wish to receive Marketing Offers, you may opt-out at any time by: following the instructions at the bottom of any email Marketing Offer you receive, informing your telemarketer at the time you are called with a Marketing Offer, calling 905-682-9229 and requesting that your personal information not be used for Marketing Offers, or emailing info@pictureframewarehouse.com and requesting that your personal information not be used for Marketing Offers. The contest is run in compliance with the Picture Frame Warehouse privacy code.
8. Banning: The Sponsor may, in its sole discretion, prohibit any person from entering the Contest whom it believes to be abusing the rules. Such abuse includes entering false information.
9. Other: Odds of winning depend on the number of eligible entries received. This Contest is governed by the laws of Ontario and the laws of Canada applicable therein and is void where prohibited by law. The Sponsor reserves the right to cancel or modify the Contest or the Contest rules at any time without notice. All prizes must be accepted as awarded, are non-transferable and are not convertible to cash. The Sponsor reserves the right to substitute any prize or portion of the prize with a prize of equal or greater value. All prizes are awarded as-is and no warranties or guarantees are implied or expressed, beyond the standard manufacturer's warranty. Prize winner is solely responsible for all costs not expressly described herein. Sponsor is not liable for any lost, late, misdirected or stolen entries or inability to process entries, or any errors, damage or negligence that may arise in connection with this Contest, including technical failures on the website or Contest software, viruses, website disruptions, malfunctions or website down-time, human error or property damage incurred by any Contest entrant. Sponsor is not responsible for any errors or omissions in printing or advertising this Contest. Use of any automated system including robotic or form filling software to enter or participate in this Contest is prohibited and will result in disqualification of all entries by anyone using such assistance. If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. Authorized account holder is the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
All entries become property of Contest Sponsor who assumes no responsibility for garbled, lost, late, delayed, destroyed or misdirected mail, tweets, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting Rules by mail or requesting names of prize winners (for which a self-addressed, postage paid envelope must be included). Contest Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials-data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsor, in its sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, Contest Sponsor reserves its right to cancel, terminate, modify, amend, extend or suspend the Contest including canceling any method of entry, and select a winner from previously received eligible entries. Contest Sponsor reserves its right to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsor reserves its right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsor reserves its right to seek remedies and damages to the fullest extent of the law. Contest Sponsor shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant's computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site, where applicable.
